Legislative Review

The Aboriginal Land Rights Amendment Bill 2009 was introduced in the NSW Parliament on 25 June 2009 and was passed with bi-partisan support on 8 September 2009. The Governor gave her assent to the amendments on 16 September 2009. It is expected that the amendments will commence operation in early 2010.


The amendments provide a much clearer regulatory framework for Aboriginal Land Councils when disposing of and developing land in the increasingly complex land dealings that Aboriginal Land Councils are now involved in. The amendments incorporate the recommendations to amend the land dealing provisions of the Aboriginal Land Rights Act 1983 following the findings of an Independent Commission Against Corruption investigation into the Koompahtoo Local Aboriginal Land Council in 2003.
